How do you go about getting POA?

My brother 65 yr old suddenly got sick and is in a care facility, health declining fast he has a 401K?His 401K is only under his name and we will have to withdraw money to pay for his care. He had a financial adviser, can it be done through him? Would appreciate any advise you can give us. Thank you.

Find any Wills deary as well . A Power of Attorney, will need to be notarized , so you need to find one willing to come to where "he is" to notarize it. Your brother must be able to sign them as well.

Explain your trying to see after his best interest with the POA's (Power of Attorneys) to speak on his behalf & handle doctors etc., so he's not placed in a position he may not want! (IE; Life Support, Nursing home, etc) .

Also, get a "Medical Power of Attorney" (these are very different, but needed, and can be downloaded free on Legalzoom)

If he's in a home already, yes emergency guardianship, AND I still would print off the POA's, fill them out , look up traveling Notary to come out & legalize them! (Bring a witness or two as well for the notarizing )!

Emergency guardianship, Pam is correct. Check with the social worker at the facility he is in, that person may be able to help you with the process. The nursing home can seek the guardianship also.

If bro is unresponsive, you get emergency Guardianship via the court. With the guardianship papers you can meet with his financial advisor and get the bills paid.
