I received 10,000. as a gift for Xmas 3-4 years ago, Do I have to pay this back before Medicaid pays at LTC?

Mother is out of money at LTC. Each of my Mothers 5 Children recieved 10,000 as a Xmas gift about 3-4 years ago and another 5,000 as a gift at Easter 3 years ago. Mother went to Nursing home 9 months ago and was private pay, she is out of money at end of month, We haven't filed for Medicaid yet as we was told that Medicaid would look at all her banking for last 5 years and any large amounts of money given out would have to be paid back before Medicaid would pay. Is this true even if money was given as a gift? does anyone know who I should talk to for an answer.

I have to agree with the above. I imagine that your mother never thought that she would need the money. Isn't that about $75,000?

Yes and anybody else that was gifted. Medicaid will penalize her an amount of time by not paying for her care. Does she have a home or anything that could be sold to pay for care in the meantime. This sort of thing happens frequently that gifts are given because parent would rather children have the money than paying for care. Not a good idea and many do it innocently enough because they don't know the law.
