My family wants to put Dad in a home. Can I stop that?

My dad just went trough a major surgery and recovery is hard. His wife my sister and brother want to put him in a home. He don't want to go there and I said he could live with me. This is the man that did every thing for me and I wanted him to stay with me if his wife wont take him. Can I fight them and win?

You can sue anyone for anything. What does your dad want to do? It would depend on whether there would be the finances there to take care of him at your house. Do you work full time? Do you have children? Also, how is your health? There is just a lot to consider. All in all, his wife actually has the say over him.

After rehab, if he still needs help at home, the discharge planner will arrange for in-home help. If you want him to stay with you, and he agrees, talk it over with the discharge planner. You don't need to go to court.

My dad was a very young 84 but has had broken his hip then heart surgery and now surgery on his tummy. I know he will have to go a few months to rehab nursing home but his wife said she cant take care of him and he may have to stay. Can I her take this to court to let him stay with me, and can I win?

Feathers, I had a knee replaced in April and went into a nursing home instead of going home. I had physical therapy every day and I made progress a lot faster than I would have by going home. In two weeks, I made enough progress to be discharged. You can still do things for him, visit him, encourage his progress, bring him chocolate. He'll be out in no time.

Nose around on here a little first. They may have reasons not to take him. Skilled nursing or post-acute rehab might be the best place for him and you might want to visit him there before you make a hasty move that could hurt his chances or really recovering functional abilities and you could end up regretting terribly.
