Mom died on 7/3/13, she didn't sign her will; need to terminate the guardianship/867 trust ASAP. I don't trust my attorney. Guidance?

My dad's will was probated in 2011. I am trying to find an original with a signature on my mom's will. I'm waiting for death certificates from the funeral home. My current attorney really wants to probate her will, but I don't trust her. (I didn't tell her it wasn't signed.) She already informed me it would cost $3000 to perform work on some issues I had with the hospital and a state agency. She didn't even want to discuss a plan of action or a timeline to address the issues, or schedule a time to meet in her office. I'm not an ATM, and I don't conduct business like that. I'm afraid to talk to the court about retaining another attorney because they act very suspicious and may not grant the request. I don't want to be stuck with the current attorney.

I would suggest checking with your County Surrogate's office and do as much as you can through them. There may be a website for the surrogate as well. Going that route can be much less expensive. If that does not help, see if you financially qualify for free legal help through your county legal aide services. I hope you are successful. I think most people want to stay OUT of probate when they can. Let me try and ask my Texas attorney friends (Katy and Seguin) if they know anyone.
