How do I get guardianship of my 80-year-old mother?

To act as someone’s legal guardian, you have to go to court to have the person declared incompetent by a judge. The decision is based on expert findings.

A court declares a person incompetent and appoints a guardian. The court transfers the responsibility for managing finances, living arrangements, and medical decisions to the guardian.

To start the process, you need to file a petition with the court. It is best to work with an elder law attorney.
