A person who is in a memory care unit requests to visit his home to find an item. The staff at facility does not think this member should.
Be transported because he has dementia and has a history of being combative and being a flight risk. Does the Trustee and DPOA have the right to deny him being transported to his home.
Yes the DPOA has this right and should enforce the denial without regret. I would also think the decision should hold based on the recommendation of the facility that the person should not leave. Use that as an excuse to tell that person to lay the "blame" on the MC facility. I would also caution that if he is "temporarily" discharged from MC, it may absolve them from any liability should something happen to him.
Yes, the Trustee and POA can and should deny such a request which likely isn't couched in any reality at all. If the person can tell his Trustee what he would like retrieved from the home, and if that is a reasonable item to have, certainly the Trustee can and should get it. But if this becomes a common problem it is best dealt with as are most issues with what someone in dementia "wants". Deflection. Waiting for these things to pass as they usually do.
If this particular item is of great value the decision needs to be passed by facility administration.
Do what the facility recommends. If he gets to his house and refuses to go back to the facility, what would you do? If he gets combative, what would you do? If he escapes, what would you do? And does the item he’s looking for even exist?
Make up a story about someone keeping the item until they can bring it to him. He’s manipulating you, so manipulate right back. He’ll forget about it eventually and be on to doing something else.
Yes. And even if they didn't, it would be unwise to give him his way knowing his history of being combative. You'd just be asking for trouble and then who would be accountable? He's in MC for a reason.
