My husband passed on August 11 check was deposited August 27 for his ss benefits do I have to return it?

JoAnn29 Aug 29, 2025
The check received on August 27 is for July. Its just like a job, you get paid after you do the work. ( his birthday must fall at the end of the month ) That should not be taken back. If it is I would call Social Security. He should not receive a check in Sept. though because he died in August.

it’s best to contact Social Security directly to avoid complications later. You can also ask about survivor benefits if you qualify. It’s a lot to deal with in the middle of grief, but you’re not alone.

They will take it back on their own. And no, you cannot sue. I’m sorry for your loss

I would be threatening to sue them if they accused me of that. Lack of communication on their part and failure to pass on your report is their incompetence. Not fraud on your part. Did you get an apology? I doubt it.

Thank you for your outrage on my behalf, however...

"U.S. citizens can sue the federal government or its branches/offices, BUT only when Congress has waived sovereign immunity through laws like the FTCA, APA, civil rights statutes, or contract remedies. The process is usually more restricted and technical than suing a private person or company." (source: ChatGPT)

So, it's nearly impossible to sue our government.

Yes. When my Aunt passed the SSA kept depositing her SSI checks for another 2 months, then one day called me up to say it was "fraud" even though both me and the funeral home contacted them to report her death right away. I had left the funds in her account untouched and SSA went in and withdrew it.

So, they will probably get it back themselves so just wait it might take them a while.
