Is there a way to protect my mother's property from Medicaid?

lealonnie1 Oct 2024
Sell the house and have mom pay for a better level of care.

You can't if it looks like she will need it in the next 5 years. This is an asset that can be used for her care. I would rather sell my home and use its proceeds for a nice Assisted living than protect it and then going into Longterm care on Medicaid.

Assistance for home care is more difficult to come by if the patient isn't on Medicaid. I would check with your own insurance, with your own country resources guides at your local council on aging. You might also ask your doctor for ideas on Social Services consult who should be aware of state programs that might be available to you.
I hope others have more ideas for you. Best of luck.

You posted this under elder law.
That is where you should seek answers to this.
For me, our assets stand to pay for our care.
When they are gone we are dependent on the good graces of our government (read--the taxpayer--you) for our help.

All options for "protecting property" have repercussions. Make certain that all involved understand all of them, and do what you feel best for yourself.
Good luck.
