Transfer of car when on Medicaid?

My aunt is in a nursing home on Mass Health Medicare for 3.5 years She owns a 2005 Toyota .... I am her POA .. can I transfer the car into my name as I use it when I am at her home on the east coast ... I life on the west coast. Her home is in a Life Estate to me and I am the only relative. Thinking I should wait and transfer after she passes. She has signed the title to me. What do you think. I don't want to wake up Medicaid. She is 100 in June and mentally with it.


 


I am also paying taxes and maintenance and upkeep on the home...

Leave it her name. Calling an attorney to ask would cost darned near as much as the car is worth.

Since you only use the car when visiting her, I think it would be best to leave it in her name, which is allowed by medicaid. Otherwise it might be seen as a gift and get in the way of her medicaid payments. But you should ask an elder lawyer about it.

Attorney who specializes in MassHealth and nursing home care ought to be able to give you accurate guidance.
Monetary value of car may affect rules.
Have you prepaid for her funeral arrangements? Are all those documents in place and do you know how to have access to other assets in a way that avoids probate?
A house on one coast and your life on the other one can get really complicated, especially when she passes. Good luck to you, and to your aunt.

Wouldn't transfer it until she passes unless you pay her fair market value for it.

See an elder law attorney prior to changing anything.
