I am a disabled daughter living in mom's house....for nearly 2 years. She is in a rest home now and on Medicaid. What are my rights?

She has a will stating when she passes that the house will sell and proceeds to be divided to myself and brother. Will this mean I must move out upon her death? Her name is still on the house, along with myself and brother. Can I take her name off or is it too late because of Medicaid? I do have Durable Power of Attorney. I don't know what my options are and am at my wits end.

Before you implode, engage the services of an attorney, preferably the one who drew up the POA. All states are different. If possible, have your brother go with you so everyone is on the same page and there’s no “he said, she said” after the meeting with the attorney.

If you get legal advice, you will know what will happen and if there’s anything you need to do now. It’s worth the money for peace of mind.
