I am my aunt's next of kin. She has dementia and is not of sound mind. There is no power of attorney how do I get guardianship?

She has been in a care home for 10 years and I have payed for all her clothes, anything she needs. I have never took any of her money from her finances. What can I do to make sure her money does not go back to the government.
