If my brother was a special needs person when the first POA was signed, will another POA override the first one he signed. He still has the same mentality and understanding now as then.

I will do that now that I have this information.

Denise, the issue isn't so much being a special needs person as it is whether he understood what he was doing, and the implications of it. If he did, then a new POA could be created, with specific language revoking the existing/old one. That's critical.

I hope you're having an attorney prepare this, especially one who has special needs legal issues as part of his/her practice.
