You can deduct the cost of the lawyer from FILs money. Medicaid will except it. In my instance, Mom is paying privately in a long-term for two months then Medicaid will take over. You may consider this. You don't file for Medicaid until your down to three months or so. Filing only last 90 days so u need to have them in a facility by then under Medicaid. It's easier to get Medicaid if they are already in LT. A lawyer should help u get thru this.

Charging him isn't going to help him qualify for Medicaid. Medicaid will look at his monthly income (not outgoing) and his assets. My FIL has lived with us for months and needs a lot of care. He doesn't drive, cook, clean or do laundry. He is becoming a financial burden. Also, eventually he will need to move to a nursing home. He has a pension and SS. He has modest assets, but a lot more that the requirement of (less than $2000) to qualify for Medicaid. He understands that he will be paying for "shared expenses", and I'm trying to figure out what is fair and OK with the govt. He will also pay for home health care. This way, when the time comes, he can qualify for Medicaid when he goes to the nursing home.

I don't understand why you are charging your father for anything? Could you be more specific? The only way he is going to qualify for medicaid is if his income is low enough to meet the standards. Even if you are trying to create another bill for him to pay, that's not going to help him qualify and if that's not the case somehow that just seems kinda cruel.

If this man needs Medicaid then he has no money. Really, you are going to charge ur Dad to fill out forms.
