my Dad is in a care facility in Miami and they have guardianship. I want to take over guardianship and move him to a facility near me and be closer with him. He is considered mentally disabled but he knows fully what's going on and wants to leave there. They just want his disability pay, food stamps ect & they are weird about letting me visit him & force me to have his social worker present the whole time

May I ask why you didn't volunteer to move him closer to you and become his guardian at the time the NH was given guardianship?
