JMI Asked January 2017

If I have a POA, do I need guardianship?

What is the difference/benefit of one over the other?

I'd consult with an attorney in your jurisdiction. They can explain the options and what you might need for various situations. The POA is a document signed by the person who is appointing someone to act on their behalf and the Guardian is appointed by the court, if the Ward is found to be incompetent. Sometimes, having a POA works well. If there is none or if the person who needs help refuses, a Guardian may be necessary.
