My Mom's in rehab in a Texas Nursing Home. Does anyone know what laws/regulations require release of all documents concerning her?

Physical Therapist was unwilling to release the documentation covering her initial assessment/baseline when she was admitted. I'm sure we will have other documentation requests as well.

File a HIPAA complaint with the Ombudsman. She is entitled to all her records and she should have a Health Care Proxy for you too. All too often HIPAA is misused to hide information. Bullsnot!

She does have the legal right to her own medical information/chart. Obtaining it shouldn't be like pulling teeth. I obtained my medical records some years ago and all I had to do was fill out some paperwork and sign on the dotted line. The records arrived in the mail in a very large envelope.

I think it's time to start climbing that chain-of-command ladder. Who is the PT's supervisor? Start there.

To clarify, my mother is of sound mind and SHE is the one that asked for the form. She was told they were not sure she could have the form. I have a hard time believing a person doesn't have a legal right to all the information pertaining to them.

Laws generally protect the privacy of a person/patient. I understand you wanting to know, but are you on the forms for medical info to be released to you? Can your mom do that now? Does anyone have a medical POA for your mom?
