Laws vary by state, some permit family members to provide care and be paid, some don't. Some states require some sort of training, others don't.

it has to be a licensed agency i believe ... you can call medicaid to find out .. but i believe the caregiver has to work for a agency ...

First the MD would have to order the care.. Medicare and Medicaid will only pay agencies that are licensed, insured and do proper paperwork. Some agencies will assign a family member to the case. Others have strict rules against it.

Laws vary from state to state. Parents doctor must document that 24\7 care is necessary. Then it must be round the clock care, by sister and others that will also be paid for care. It is very important that sister has some respite. If the care is required and if Medicaid is ever a possibility, there must be a caregiver agreement in place prior to any sort of payment that is in compliance with Medicaid regulations. Money will run out quite quickly unless folks are extremely wealthy. Contact an elder law attorney for assistance with preparation of agreement.
