First the MD would have to order the care.. Medicare and Medicaid will only pay agencies that are licensed, insured and do proper paperwork. Some agencies will assign a family member to the case. Others have strict rules against it.

Laws vary from state to state. Parents doctor must document that 24\7 care is necessary. Then it must be round the clock care, by sister and others that will also be paid for care. It is very important that sister has some respite. If the care is required and if Medicaid is ever a possibility, there must be a caregiver agreement in place prior to any sort of payment that is in compliance with Medicaid regulations.
