What duties does an elder care lawyer perform?

DonnaRN May 2013
Elder law attorneys can provide power of attorney contracts for health and property, estate planning, and guidance in setting up special needs trust to protect assets for care of a spouse remaining in the community when another spouse needs nursing home placement, planning and educating the client on special benefit programs such as veteran programs and medicaid under the state law for seniors.
They can assist by petitioning the court for guardianship if disabled adults who have been deemed incompetent by appropriate medical and psychosocial, and neurological testing. The team of an elder law attorney and a geriatric care manager can help guide a client in the planning process of caring for a loved one, thus saving them from making costly mistakes in care planning.
