What are Medicaid laws pertaining to paying back Medicaid after death, when person still has property?

The money Medicaid paid out will likely come out of the property. You may want to check with an estate attorney. State laws with Medicaid can vary some.

If the person has a checking account or any other resources, other than property, these too will need to be repaid to the state after final expenses are paid. It does not matter that the money may be willed to someone. In my state if anyone over the age of 50 dies on Medicaid, whether or not she/he was in a nursing home, all goes to the state.
