How do I handle an unfit sibling who has guardianship of my parent?

My sister received guardianship fof my 94-year-old mother with dementia, but she is unfit. What can I do to obtain guardianship?

EXPERT Ralph Robbins Sep 2010
You will have to petition the court. If you are challenging an existing guardianship be prepared for an expensive process. To have been appointed guardian your sister would have been deemed fit by the court...a responsibility the court generally takes very seriously. The court doesn't like to be told they are wrong. You can try handling this pro se but it is unlikely you will be able to make a sufficient case on your own unless there is something glaring that the court missed or something substantive has changed since the appointment.

My 83 year old aunt home is unfit to live in. My 63 year old male cousin lives with her. She has brain washed him that if it wasn't for her he would be dead. I have offered to help but my aunt is a controller and refuses the help and says they are getting along fine. She can't see to drive so my cousin goes with her everyone to help her see. She has hit a motorcyclist who stopped to fast and side swipe a car. My mail cousin has fallen and broke his knew cap, can't get around the house due to my aunts hoarding. what legal action can our family take?

CHRhelp: I would suggest you go to the town hall and ask to speak to someone in the property maintenance dept. When they inspect the home, they will see what you are dealing with and be able to direct you to the proper authorities. The senior services division of your county should also be a resource.
