I am my mothers poa for healthcare. She lives near me in a care home and I am on the front lines of her care. She is in the later stages of dementia and can no longer talk or walk. She is 91. My older brother is her financial poa and he will not allow me to have access to a copy of the whole trust. I did have access to a copy before we moved mom as she wanted all of us to have that access but when we moved her he took the copy that was hers. There is nothing secret about what is in the trust but I would just feel better knowing we all (I have one younger brother) have access to my parent wishes( dad died 15 years ago). My older brother is a loner and the suspicious type. He is not involved in her car and live hours away from me. Mom wanted us to all work together and he will not. What are my rights concerning the trust and access to how he is managing her money? Thank you! Kim

This is just a comment, but, yes, the beneficiary has rights to see the Trust, however, we had to get a lawyer to get my dad's lawyer to cough it up, he refused to show it to us when we asked him to see it. It's amazing how devious people can be. My sister and I are the beneficiaries, and we had to go through 2 lawyers and almost 4 months to get my dad's estate lawyer to hand it over. It was only because he couldn't bully or BS our new lawyer the way he did with the first one, who was a woman. Come to find out, he had coerced my Dad into removing me as the co-trustee and he then made himself the Trust Protector, which he kept trying to talk my Dad into previously when we had meetings with him, and my Dad didn't want him to be the Trust Protector. My Dad has dementia, and at the time of that signing, he was already showing serious signs of dementia, but he hadn't been diagnosed yet, so his lawyer got away with it. Very devious and self-serving, and not respecting my father's wishes at all. Had his own agenda, makes me sick. After my father was diagnosed, he kept trying to fire his lawyer, but he won't honor my Dad's request, sighting the dementia diagnosis. He's still in place, unfortunately.

Only the Trustees and the beneficiary have rights to information. You are working together, you with her care and he pays the bills from the Trust. If he stops paying the bills, you take him to court.

Any chance you can get a copy of said Trust from the attorney?
