My mother has dementia and depression but refuses to take meds. My dad passed 4 yrs ago and she refused to put anyone else on the deed for her house. I am POA and have my name on her saving and checking accts since my dad died. If she needs to go to a nursing home can they take all her assets? I am lost at this point and dont know what to do.

I also feel lilliput has given very good advice-and what she has expressed is the cold hard facts. An elder Care attorney-or even your local agency on aging are people who can walk you thru this..and it may be worh a call or visit with them

Very good advice I would go to an elder lawyer once you see the medicaide application and start the paperwork you are going to need help-I am not sure how much help medicaide will be for you if they are like medicare answering questions every call gives you different answers to the same questions and you would first have an application sent to you and then they would make an appointment for you with social service-at least that is how it is done in my state-the elder lawyer will know what the rules are and will help you do the paperwork-good luck trust me you do not want to do it on your own.

If you are thinking about a Medicaid facility, there is currently a 5yr. look back period for most of her assets (some are exempt.)
You may also want to ask about Living Trusts wherein you become the trustee. I believe everything under the trust is protected (after the 5yr. period, of course).
Your best bet is to contact a Medicaid or Elder attorney. They know the ins and outs of the system and can guide you best.
