Robert, there could be so many issues with an IT that this is a situation best discussed with an estate planning or elder law attorney.   

Some issues, e.g., the reason for an IT as opposed to an LT, other estate planning documents in existence, family situation, elder's situation, and more.

You need an Elder Law Attorney or Estate planner. Please don't take the advice of people on a forum as regards things this important.

If you are dealing with an attorney who is in anyway confused on this question, you need a different attorney. A certified elder attorney well versed in Medicaid and VA benefits for your loved ones state would be Best.
