VA Survivor Benefits & Inheritance Money question. My Mom needs to be in an assisted living facility and we are just starting the process of applying for Survivors Benefits and Aid & Attendance Benefits. My brother (her son) passed away last year and his estate just got settled. So now she has all this extra money in her account which she will need to help pay for the assisted living facility. Will that lump sum count against her getting the VA benefits?

To qualify for A &A benefits she cannot have more than 60,000 in assets. If she has more than that use it to pay her care bills and when she gets to 60,000 then apply. Otherwise she will be rejected and you will just have to do it again.

But will it interfere with getting benefits? Is it considered a gift?

Yes. You must fully disclose this to the VA.
