You have to file for guardianship (also called conservatorship) at the courthouse & it usually is done by probate court judge. ALthough you can file a G/C on your own, almost all the time you need an attorney to represent you through the hearings. It is an involved legal process.
It is NOT just filing paperwork to get a G/C. The person you are wanting to be a guardian of will need to show that they are in need of oversight. Like for elderly - they need at least 2 doctors letters on their mental & medical need for a G/C. Also you have to show you would be suitable to be a G/C - the court can do a background check on you. You have to have your own source of steady income, no felonies, good credit and no tax issues, etc.
Most of the time, a DPOA can get a lot of the same things done for an elderly parent. Is there a reason why a guardianship rather than a DPOA is needed?
