My mom passed away 2 weeks ago. I had POA and I am on her checking account. A few people are telling me that I have got to return money back to state, and the memory care center is also telling me that because she didn't use her 30 day stay that the state takes the money. Can someone tell me what do I need to do or who do I call? Thanks.

I had the NH set up as Moms payee. That way, in the end, the NH was responsible to see SS got paid back if home was overpaid. SS was retold about her death by the Funeral Home. I called the former employer about her pension.

I'm sorry for the loss of your mom.

If your mom received SSN for the month after she died (ie passed in March, received SSN check in April), SSN will do a reclaim for April's payment. If SSN has been notified of the death, they will take the necessary steps to reclaim the money, and will contact the bank or credit union to let them know that they are going to do this.

You don't have to send that money back. That is her PNA (Personal Needs Acct) correct. In NJ it's $50 a month. In my instance, the NH held the acct. All I had to do was prove that I was Executor and I received the balance in her acct. It became part of her estate. I have used it to pay for things that have popped up since her death. Same with the spend down money left. It becomes part of the estate. I agree about unused money for her MC goes back to SS.

Keep the account open for a while. My Mom has been gone six months and SS has not requested the money back probably because that was her money.

I'm so sorry about your losing your mom. And yes, it does seem that these paperwork things hit  when it's all so new.

When my FIL passed at the end of January, we were told that the SS deposit to his account on 2/2 was for January. So, we're to leave at least that amount in the bank account and SS will do a "clawback".

I open a checking account for my mom when she when into the memory care center..so the account is under my name and my mom’s name..the memory care center gave me a number to call to see about sending the money back to the state which came from her social security check each
Month.(for the last 4 years)and the money in her account was the money left after paying the memory care center..that I use some to buy her clothes and etc..so they are telling me that I need to return the money back to the state..( that is in checks big account)and she was paid up for 30 days in the month of March and she died on the 20th..so I know that goes back to state what every days she dnt use..but not sure if her checking account..yes it’s a shame that they throw this at me when my mom just died..

I’m sorry for the loss of your mother. I’m knoe it’s stressful to have these kind of issues to deal with right after her death.
I’m not sure I understand what you are asking.
Did you take money from your mothers account? Her social security?
Give us a few more details and hopefully we can help you figure this out.
