There are 5 siblings and the youngest is pure evil. She arranged for her solicitor friend to have LPOA. After my father died as executor he bullied me. Our mother was in the same fabulous care home yet earlier this yr when mum went into hospital suffring a heart attack this siter cancelled the care home along with the help of the solicitor. All the social services could get from her was that it was a mis understanding. WHAT. we believe he is keeping this sister informed of all expenditures but not the 4 other siblings. mum has now been in hospital for 8 months and when we found a lovely home to take her this sister objected. So mum now remains homless.does the solicitor have to inform all siblings as mum has no capacity. Or can he choose just one, who is not the next of kin.

Wilfred, I don't know all the rules regarding care homes and especially since you're not in the US, but, they can't keep a bed or room reserved for a resident for very long. If the bed is vacant, they need to fill it with someone else. I'm sorry that all of you siblings aren't on the same page. Maybe it's best that an unrelated person is POA. In my experience, it's unusual for someone to be hospitalized for 8 months for a heart attack. Is she receiving any kind of rehabilitation? All of you children would be considered next of kin. It would be nice if the solicitor kept all of you informed, but s/he isn't required to. I hope your mother recovers soon.

In the UK, LPOA (lasting power of attorney) is a tool to protect the patient. Now mum is obviously in disrepair if she is still in the hospital after 8 months. Are you certain this is not a long term care facility within the hospital campus?
As for sharing information, the LPOA is actually required to maintain confidentiality. So is the HCP (health care proxy), most likely your sister, who makes health care decisions, then asks the LPOA to fund them.
