In what situations would the executor not be responsible for paying taxes that are owed by the estate??

If the estate owes taxes then they will likely have to be paid. If you think something shouldn't have to be paid, you should see an estate attorney for an opinion and some help. The executor isn't generally responsible, personally, for expenses. It comes from the estate. But again, and estate attorney may be needed.
