My 90 year old mother has been in the nursing home for about 2 weeks now and is seemingly better physically, but is on the downward spiral in her dementia and does not have Medicaid or Medicare, however her POA just applied for her. My husband and I are undergoing bankruptcy and are being sued for credit card debt so we obviously cannot pay for any nursing home care if they should come after us. Would we be held financially responsible even considering all of that?

Is your parent a green card holder or visitor to the US? This may limit her access to programs like Medicaid depending on the state she lives in.

I was wondering if 90 isn’t a typo? OPs profile says her mom Shirley is only 60 which would explain why she’s not on Medicare.

Did you sign any of her paperwork when she went into the NH, or did the PoA take care of doing that?

No we didn't sign anything, only her POA.

Xuchil, since she apparently lacks the necessary finances, ask the social worker if she'll help with the Medicaid application.   An SW may be able to help the proxy (under POA) push the process along. 

I'm curious why she doesn't have Medicare.  What's the story here?  Has she been w/o medical insurance for years?
