Nursing home he is in has 10 Medicaid certified beds that they are in the process of getting decertified. He will run out of funds within a year. Does the facility have an obligation to provide him a place while (if) they still have Medicaid beds?

I don't know what they are "obligated" to do. If you didn't get something in writing that Medicaid would be accepted from this resident, I'm not sure there is any recourse. Discuss with the billing person whether they intend to hold certification for current residents who are "grandfathered" in. Discuss what options they suggest.

If he is going to have to move when his funds run out, it MIGHT be good to do it sooner than later. You may have a wider selection of care centers if he can be self-pay for a year or so first. This seems to be a regional thing and it might not apply in your area.

Having worked admissions and social services in a nursing home in IL, you need to read and or ask what the Resident's Rights are while residing in a facility. If we, for any reason had to have a resident leave, we were responsible for finding another placement. This is a regulation mandated by the State of IL. You need to speak to the Administrator, and then contact your state's Department of Public Health for further info. Good luck!

A lot depends on whether the facility is opting out of Medicaid or being forced out of Medicaid for non-compliance. Read all the documents carefully, there will be deadlines posted. Ask for an Ombudsman to assist you.
