I spoke to my siblings about getting Mom a newer vehicle thru the family trust. They were on board but it is up to me to do all the research ect. I am my Mothers main caregiver and need reliable transportation for family events, doctors visits ect. I finally told them that I would not be driving my 90 year old Mother to visit relatives in a car that can break down at any minute. I am also disabled and physically unable to walk for a couple of miles to get help. So what I am hoping for is she is able to get a new vehicle but keep my name off the title. That way when she finally goes into assisted living she can just sell the car. Anyone got suggestions?? Thanks

What kind of suggestions are you looking for? The kind of car to buy?

Is there no way that she can purchase the car herself, or does her condition prevent her from doing so? As her main caregiver, you should have a full POA, that allows you to sign for her, this way the car will be in her name, but you will sign the paperwork.
If the dealership will not accept this kind of legal paperwork, I'd contact the lawyer that set up the trust and inquire how you might go about doing so.

If you have the title drawn up as "or" as opposed to "and", both of your names can be on the title and either of you could sell the car independent of the other.

With your Mom's Age, I think the best thing will be to have her as a co-owner and someone else as the owner. Who is to be the owner? At least the driver or someone living with her due to Insurance issues.If you don't want or can't due to any reason, any grandchild or niece can help. When is time to sale the car it will be easier if the car is under two names, either any of the owner or co-owner can do so.

Talk to your insurance agent about how the car needs to be titled so you can drive it on your mom's behalf. In my state it can be titled to mom, and someone else can drive and be insured, but there are some 'hoops' to jump through.

Hadenough, I agree with Rackem, if you put "or" on the papers either of you can sell the car when the time comes. It's like a joint bank account,....your checks say "or" between your names, this way you don't have to get the other joint acct. holder to sign the check before cashing.! Good Luck!

It doesn't sound like money is an issue. Help your mother purchase a car outright (a late-model used vehicle is the best value) and have both names on the title. Ask her what she wants to happen to the car once she passes - either you keep the car as part of your inheritance (if you need a vehicle, and it sounds like you do) or sell it as per her wishes. You are her main caregiver - your arguments for a new car for her are valid - and your siblings shouldn't have a problem with any of the above as long as it is all presented in writing, right?

As an aside, if the title is "and" instead of "or", it's not an issue as long as the death certificate is presented to remove your mother from title.

Dear Hadenough, if you get the car in your Mother's name, and she goes into assisted living, the car will be listed as asn assett, and then they will take the money from selling the car, your Mother will loose that money. If you have the money out right to buy the car, then pay cash for the car and put it in your name, not her's, you are the caregiver, and God forbid, if she passes you will not have any transportation. You deserve it.
