My mother has given me Power of Attorney, but I realized in the state of Georgia there are supposed to be two witnesses that sign it. A Notary Public signed it as both witness and notary with no other witness signatures. Since a document like this does not need to be notarized, does the notary's signature and notarization make it just as valid as having two signatures?

Sapphire, every awkward seemingly hopeless situation needs a hero. You have the opportunity to be that hero for your mom. Loving cards expressing nothing more than your wish for her happiness -- leaving all rancor behind -- is a wonderful gift here.

Maybe send mom some pretty stationary, a sparkley pen and some stamps so she can write back.

@Maggie you are right, I don't have to be in charge of anything like that anymore. I guess no matter how they went about it would have been a battle. I have been the caretaker for many years........and I don't have to have that responsibility anymore. I was expressing my hurt feelings of the no contact on all matters, I was trying to include her in regards but there is silence. I will start with the certified letter and try communicating with my mom through cards......Her birthday is coming up.......I hope they will give her the birthday cards.

Sapphire, if you are not careful, you are going to find yourself on the wrong end of an inquiry by your area's district attorney's office. You don't know that your mother is being manipulated for you haven't seen or talked with her since she moved in with your sister.

What you DO know is that you're not in charge of her money anymore. And you don't have to be. She's not living with you any longer.

Oh, I am sorry....the document itself is on the MD's letterhead and only the signatures of my mom and her MD at the time are on it. No notary, no witnesses.

My mom never revoked it. She has a copy of it in her files.

Thank you. Ok, however.....this document that I have been using.....was created in 2012. And I thought it was a legal document. I did have to send this to individuals who requested documentation that I had authority to information for my mom. After I did so they released and talked with me. I know have a different scenario as my mom is now staying 900 miles away with another sibling. Who is refusing to let me speak with my mom. They have also transferred my mom's money to a new account but left open our joint account. I know my mom has advanced mid stage Alzheimer and being manipulated. I am now uncomfortable about saying to them...you can not keep me or my children or grandchildren from talking to our mom. And that is exactly what she is doing.

Sapphire, here is what I found regarding POA in Georgia. •To create power of attorney, you'll need to compose and sign a document granting this authority and ask two adult witnesses to sign as well. Although it's not required in all cases, it's often a good idea to seek out a notary public as a witness [source: https://georgia.gov/popular-topic/granting-power-attorney]

My mother's MD drafted a letter stating that I myself had the authority to act as my mom's agent in regards to financial and health matters. It also stated that my mother was competent and acknowledged this Both signed off on it. Is that a good enough POA letter.

I agree with cwillie above.... I doubt that POA is valid. There weren't two witnesses, plus Notaries are prohibited from notarizing their own witness signatures.

Here in the Commonwealth of Virginia for example, the Principal [my mother] had to sign the Power of Attorney...... another signature would be the person who accepts the delegation of authority set out in the Power of Attorney [me].... then there are two witnesses to my mother's and my signatures saying that both of us were in sound mind and memory and under no undue duress or constraint.... and everyone's signatures would be notarized.

I'm not from Georgia but I would doubt the poa is valid. Generally there are strict guidelines about witnesses, even for those downloaded forms. I made certain my mom's healthcare poa was witnessed by 2 neighbours who were young enough to be still around in the future to certify they had indeed witnessed mom's signature and we read it to her and she understood. Her financial poa was done by a lawyer and witnessed by his staff like any other legal document.
