Can she change her POA and does the opld POA have to turn over all of the love ones records because she has been keeping all that information from her.
The only person who can change a Power of Attorney is the person who gave authorization to someone to represent her in the event she is unable to make decisions for herself.
By chance is the person your Mother who is living in Assisted Living, as per your profile? If so, does your Mom have any memory issues? If yes, and its to a point where your Mom wouldn't be able to understand the legal documents, then that POA cannot be changed. If Mom is still pretty sharp, good, then Mom can change the name on her Power of Attorney.
It would be best to use an Elder Law Attorney to make these changes. The POA would need to say that this is for medical and financials. Then once signed by everyone who needs to sign, the former POA would need to turn over all the financial paperwork to the new POA.
