I posted under Elder Abuse as my older brother who lives with my 90 year old Mom has been abusing my Mom.


My Mom finally signed the papers to sell her house. My brother has been living with her for over 10 years and never paid rent or any bills. I live 6 hours away from my Mom and once the house is sold my Mom is going to live either near me or with me.


Is it possible that the next time I go to visit my Mom that I can go to an elder care attorney with my Mom and have her sign the papers so I am in charge of her finances and health decisions? Or when it comes to my Mom's health would I be a guardian?

If you mom is mentally competent and agrees she can designate you as medical and financial POA. You would then be able to handle her affairs. It is an essential step for eldercare. You want to talk to an attorney about a broadly worded, durable POA.

Thank you. I had a long talk with my Mom and she agrees 100%. I believe she is mentally competent even though she is showing signs of early dementia. I found some attorneys that give free consultations who I will call this week.
