This man paid himself grandly for 6 years at $500.00 a month and he made a few trips to Alaska and went on cruises during this period. He does not have the income to do this and used up all the monies available. He also signed over land to himself from the estate. I found out I am heir to the property and also the executor, but there are thousands of dollars worth of debt from the nursing home against the property and if I decide to pay off the debt to gain a clear deed I must also PAY THIS MAN for the land that went with the property that he signed over to himself,so the property will not be split in half. I really think he planned this out so I would be forced to give him more money. What can I do about this guy? There is no family relation involvement here between us.

Report him to the police but they will probably tell you it is a civil matter. Get a good elder law attorney.

If he abused his power of attorney to benefit himself through this land acquisition, it will be interesting to see how he plans to enforce his rights to title.

You need to see a lawyer: one with a good track record in untangling messy estates and negotiating settlements.

Whose is the estate? Why did the testator choose this man as his/her POA, do you know? (Just curious)

The estate belonged to my neighbors of 44 yrs. They had one son that dis-owned them 30+ yrs. ago. This man talked the lady (90 yrs.old)--who had dementia into appointing POA him less then a month before her husband passed. The husband was at this time in a fetal state and could not talk(cancer). This POA was a distant cousin of the dying man (90 yrs. old) who never showed his face until they were in this state of health. He is known for doing this in our town--this is the 3rd party he latched onto when the people were helpless. Difference being the other two ---he ended up with the whole estate---no one else was in the picture. This time he thought he was in line for the whole thing again--but found out way before I did---that they left it all to me and my husband--hence---his behavior. So no one ever pushed this before---but he was nasty and mean to my friend and neighbor after he put her in this home--where she passed last month--after 6 years. I did their banking--paid their taxes etc. all through the years---I KNOW how well off they were--and in no way should her finances been depleted--even after 6 yrs. He never once took her the personal items she needed on a daily basis--didn't even take her clothing to the home--just dropped her off--and left. These people did not deserve this treatment---and couldn't even defend themselves----I ended up on medication through trying to deal with this guy while taking care of these people. He even stripped the house of the contents---took their car--
and still has the house keys!!! And it's mine. He took 2 truck loads of furniture and other items from the house AFTER she passed away on top of all this!!! The material things really don't matter to me---but he needs to be punished in some way for taking advantage of these people.

Since the guy is not the beneficiary on the will, talk with a CPA and issue a 1099-MISC for the money that he took in the last year and property. He paid himself - he owes taxes on it. They could not gift him unless the power of attorney allowed it. It may have had language for getting paid, and you might consider that if you cannot file an elder abuse claim. Remember, Al Capone never served a day for murders, but the IRS put him behind bars:)

Also, think of this: what's to stop him doing it again?

If you can prove what happened to your neighbours, and if what happened to the previous victims is also well-documented somewhere, surely some legal use can be made of this. I hope you'll find good professional advice and have some success in biting this lowlife where it hurts him.

Would I be able to request an accounting of this guy and where all the money went and how it was spent, since I am the heir to the estate? Is that something that could be traced through the bank records etc?

I'm also interested in looking into insurance policies and who cashed them and where that money is, since this guy got all the death certificates and I have none. The passing of the lady in question took place a month ago and I still have no certificates. What could he possibly want them for since he is no longer involved since he's not in the will ?
