My father went from board and care home into hospice, died 2 days later. In home 7 days this month, can they refuse to refund the 3 weeks?

Was this assisted living where he had personal items in his room? I don’t think they consider him out until you officially move him out.

My father was in rehab since May. I officially moved him out of AL first week of July. They refunded the balance of July’s rent and the additional care cost for June and July.

It really depends upon what it says in the contract that you signed.

Just remembered I did not give 30 days notice either. When it looked like he was not going to return to AL, I contacted them and said I would be cleaning out his apartment in the next week. They still gave me the rest of the month's rent back.

Read the contract. Did you remove him from Board and care to hospice knowing he would not be returning to the board and care? If so, then 30 days needed to be given. Now if hospice was done at the Board and Care and he died there, then there is no way you could have planned for that and I would think they need to prorate the days left and give that money back.

Just a thought, is his care separate from his rent? If so, they maybe able to keep his rent but should refund his care since they are no longer giving it.

It's all about what the contract says, but it might be similar to an apartment contract. If they can rent the room before the end of the month (and they need to make an effort to do so), then they would owe you a refund from the time they rented. If they don't rent it, you might be out of luck.

Is this hospice that is not covered by medicare, because generally there is very good coverage for hospice. I know nothing about in - facility hospice, but the papers you signed may explain it. There generally are clearly stated rules. Places differ. The Assisted Living my bro died in early May, once the room was left in good condition and all cleaned out, actually refunded me the rental for the rest of the month, which surprised me.
Do read your contract and see what you can make out.
