Hello. My father 80 years old and he has 5 credit card with total of $16000 debt. He has very poor health and only received $1200 social security income. He gift me a house around 3 years ago. And also he, myself and my mom on my car title. My car is paid off. I am his power of attorney. Now he can’t pay his cc bill. Do I need to pay his credit card or I am not sure what happens if he stop pay his credit cards?

He has to stop using the credit cards. If there are more than one card, I suggest getting a consolidated loan. This will give him only one payment. I would call your County Office of Aging to see if there is a credit councelor who can help you figure out your fathers best options are. I really don't see how an Elder Lawyer could help in this and they are expensive.

I suggest you take him to Social Services. There is a supplimental income he may be able to get. He maybe able to get food stamps.

Hopefully he's the only one whose name is on those cc's. If so, and he really doesn't have any other assets to pay them off, then you will need to dodge creditors (ie, do not communicate with them, send back all mail unopened, etc). Make sure you take away his cc's so he can't buy anything going forward. You can sell the car he gifted to you to help pay his living expenses.

If he cannot afford basic necessities without buying them on credit, and he gifted you a house within your states Medicaid "look-back" period, then you need both financial guidance and a consult with an elder law attorney.

You may also want to go to a public financial forum called bogleheads.org, where you can get suggestions on what to do about his financial situation.
