My sister had her on weekends and he took my pay and gave it to my sister. Is he allowed to do that when I'm a caregiver and co guardian of my mother?

I understand that he is trying to pay her medical bills, do you have documentation proving this is how her money is being spent. I find it admirable that he wants to do the right thing by her creditors but her immediate food, clothing, shelter, medication and caregivers need to come 1st.

I would ask the court if it is allowable to neglect her care to pay past bills. I don't know how anyone can be fed for 100.00 a month. That's only 23.25 weekly. Not including water, power, rent. Housing another person costs money, no matter how minimal, they still require resources.

I would figure out your monthly bills and petition for a percentage. If there are 5 people in the house ask for 20% of the monthly expenses, if there are 3, petition for 33%. This would not include payments to you for your services, that would be extra. Be prepared to provide actual bills with actual proof of payment, if you get any assistance that needs to be calculated, if your gas bill is 150.00 and you get a credit of 100.00, your actual bill is 50.00. Are you following? I can read from your responses that English is not your 1st language, no offense intended, I am trying to simplify so you understand completely. We use alot of slang and multiple meaning words that cause confusion, but you know that.

Approach this without any emotion, put the paperwork together and show the court how much you spend caring for mom, how many hours you spend caring for her, keep a daily calendar and list everything you do for her. This will make a greater impression than any tears or upset would.

I hope you get what you are hoping for in this difficult situation.

Im calling legal aid tm to get them to help me at court because he's trying to accuse me of fraud when I'm not even getting her checks he gives he 100 a month for herself and she buys stuff she wants.im not sure where the fraud comes in if I'm not getting her checks

And without a care agreement this could mean big problems getting her qualified for Medicaid paid nursing home if that becomes necessary.

Bro must be her financial POA? What does he do with the remainder of that money?

If your mom lives with you, you should go to SSA and get yourself set up as her representative payee. He is required by SSA to only pay for moms care, if he is keeping the lions share he is stealing from her and you should file a complaint.

Get this on their radar asap, he can actually be prosecuted for taking her money and not paying her expenses.

My mom is in a wheel chair full time and have dimensionia I pretty much have to do everything and she's live with me for almost a year now

My sister is the one who offered to take her for nothing but then I offered to pay her 50 then I was paying her 100 so when my brother took my pay and gave it to her he never even discuss it with me he blindsided me with it I haven't had hardly no money to take care of my mom and my husband is on disability and that is monthly. Somebody advice me to call legal aid for help

My brother pays me 100 dollars a week and a 100 for groceries for the month and my mom gets 1600 a month so altogether I get 500 a month and I'm a caregiver and a co guardian too

I am assuming here she is being paid to care for her Mom and sister gets paid on w/e.

You should be being paid the same amt per hour. So if sister did 48hrs for the weekend and and you did 120 for 5 days, you should be paid accordingly. You don't mention how much he gives you monthly.

What is “co-guardian”. Is this legal? How did he get your pay? Who gave him rights to your pay? We need more info here. Sorry.

What your brother did doesn't sound fair or right. Do you have a care agreement that spells out what you do and how much you should be paid? If you don't, it's time to sit down with all involved and work that out.
