Mom was on Medicaid in the nursing home. She had no assets when she passed away except for $337.37 in her checking account. I have been expecting Medicaid recovery to contact me to get whatever money was left over but have not heard from them. I have tried to call the long term care office with our state and left a message but it has been 3 month now and nothing. Is is safe to close her bank account? Again she had no assets and there will be no probate.

The money in her account is spend down money correct? Its Mom's money. That is what she was allowed. Its part of her estate. As is the Personal needs acct she had at the NH. You may need a short certificate from probate allowing the NH to turn the money over to you. You need to call the NH and see what they need.

If Mom has no house, the recovery letter will just tell you what they paid. They will ask if there are any assets, you say no. Of course there were none when she went on Medicaid but recovery is a different dept. When I called them because I was selling a house and had heard nothing, I was told they hadn't been told Mom passed.
