My mom started out in assisted living and after 3 years was moved to memory care, in the same facility. She's been there for 10 months, she has fallen at least 10 times since she's been in memory care. Most recently, mom has fallen 5 times in a 10 day period.
The director and nurse met with me and they have expressed to me that they feel my mom would be better off at a residential care home.
The director has asked me to find a new place for mom asap, as she is a fall risk.
Can the facility "Legally" ask me/force me to move my mom? I was lead to believe that my mom would live out the remainder of her days at this facility.

This is so eye opening to me. I am an RN and my Mom is aging and failing pretty fast. We have home care a few hours a day but not 24/7. I live close by and it never entered my mind that if we decide she needs to move to a care facility it might not work out. I was even surrised that there is residential care in a private home option. I have strived to keep my Mom in her condo (paid for) and bring in the care she needs unless its 24 hr medical. Thanks for sharing. I hope it works out for you.

I don't know if they can legally "force" you to move her, but it may have to do with what they are/are not allowed to do to restrain her from falling (out of bed, or while standing?). Residential care homes (the 6 resident type) have a 1-to-3 staff resident ratio, which is actually the huge upside to a board& care. My own grandmother is in one, and we have been thrilled with her care (but shop carefully -- several we looked at were grim, grim, grim!). Was there a "buy-in" at this place? If so, (and it was several thousand $) you might be able to negotiate for a return of portion of it based on the fact that they have NOT been able to live up to what it sounded like they were offering at the time she moved in. It does sound like they are trying to suggest what is best for your Mother though -- I don't think they OR you want her to get hurt falling.
