Spouse has $2585 monthly pension from work. If spouse has to go into a nursing home, do I lose the $2585 if he cannot be cared for at home. I know the social security will automatically go to nursing home. I am on Social Security Disability and that will not cover our small two bedroom home expenses. Need to have some of the work pension to live for expenses.

You are the Community spouse. If your spouse is receiving nursing home Medicaid, you keep the income you need to remain in your home.

Contact your local area agency on aging for advice about this if your finances do not allow a visit to a certified Eldercare attorney.

Are you anticipating help from Medicaid? The rules are very different for single people than for those with a community spouse (you). The intention is to not impoverish the spouse who remains at home. The couple may keep a substantial amount of the assets and some of the income of the spouse in the NH can go to the community spouse, rather than to the NH.

To start the ball rolling, even if you don't really need it yet, call your Area Agency on Aging or your county Human Services department, and ask for a needs assessment for your husband. In most states Medicaid has some programs that can begin to help when the person is still living at home.

The answer is yes...but

The community spouse ( the one not in the facility) is allowed a $2,000 monthly. The amount varies some from state to state.

So, the difference between your ssdi and the allowance, you would get to keep each month from his income

I sometimes wonder when the time comes will it be just better to sell the two bedroom home and go into an ACTS retirement CLR where his pension, his social security and my social security will cover the monthly fee (the sale of the home should cover the entrance fee). That way when a level of care is needed, we do not have to worry about medical care as that was part of paying an entrance fee with the sale of our home.
