You do need to see an Elder lawyer to split their assets. Then maybe you can find her a nice AL or a nice apt for both of you.

Have you taken your mother to see an Elder Law attorney?

Is your mother considering filing for divorce?

Why doesn't your mother move out of the marital home and find herself a nice Assisted Living place?

Are you mom's Power of Attorney? If someone else is, and if mom is of sound mind, she can change that, to you.

If she is of sound mind, you can't get guardianship, because she's still competent.

Because she is still competent, shee needs to make these decisions for herself.

Starting with leaving her abusive husband and filing for divorce
