My mother has lived with me for 3 years and my Dad passed 7 years ago.. I have POA but now need guardenship. Where can I get the guardenship forms in Oklahoma since she is willing to sign. Will we have to go to court? Thanks in advance for you answer. I really need an answer to wheather or not I can get guardenship without a lawyer.

I agree with Sunflo2, since your mom is willing to sign (assuming she is competent) there is no need for a guardianship. Guardianships are about someone being declared incompetent and a judge assigning a guardian. It does take a lawyer as someone has to represent your mom's interests. The first thing our lawyer wanted to know was why we needed a guardianship. Our answer was simple as IL's were both suffering from dementia and no one wanted any more arguing between family members. There had been a lot of arguing between the other siblings and the aunt who held FIL's POA.

Examine your POA; you may have medical and financial control through your POA if it is a DPOA and therefore not need guardianship. If in question; contact an elder law attorney who may review for you over the phone at no charge. Check out Money and Legal Tab (at top of this site) for more info on POA powers.
