My sister is laying about power of attorney to the hospitaHow can I check public records she has power of attorney.


Police were called and she admitted she does not have POA to an officer on 12/1/2025 . The officer was able to state there was no power of attorney at the rehabilitation center today 12/3/2025.

My POA was on file with every doctor, hospital, facility and bank Mom did business with. No one should except someone saying they have POA unless they show paperwork to that effect.

It would be nice if POAs were filed with the County Court but not in my state or many others. If a LO uses a certain lawyer you can check with them.

Health care power of attorney documents don't have to be recorded. Health care providers should have them for patients, but they should not be releasing them or information they contain to anyone other than the principal or the agent.

Power of attorney for whom? Your mother or father? Can you ask them who they nominated as POA?

Another option would be to tell the Hospital admin that your sister is claiming to have POA but you suspect it isn’t true. The Hospital can check (and should check if your sister wants some type of control) even though you can’t. It may be tricky what they can tell you, but you can perhaps get some idea if they tell you that they have checked.

If your sister isn't trying to make decisions, consider whether she is just telling porkypies to upset you and it's of no relevance anyway.

'Verified by legal documentation' only works if the verification is required. Sometimes just a statement "I have a POA" is accepted without verification. That's the problem!

I had to supply Rehab and all financial institutions my POA form. So if she cant produce the form that is a good indicator she isnt POA.

If she can't provide the form she can't legally sign anything as POA. If she does it is considered fraud and legal actions may apply.

In all my dealings with hospital, SNF, Nursing Facility and ALL financial institutions my POA form was needed to represent my uncle.

She can't assign herself POA without written consent of that person. And, if the person is incompetent or incapacitated the POA then becomes invoked for a majority of POA contracts.

There is no need to file a POA in any public records.
It is up to those entities that your sister is acting with to check the POA. So, for instance, if you are worried Sister is lying to the bank, you should understand that banks check POA VERY CAREFULLY as it is their Fiduciary duty under the law. If you are worried that a false POA was given to the doctors, I would call the office and say that you suspect Sister is presenting a false POA to various entities.

You have made a big accusation here. If you TRULY are worried and this seems an abuse to you do know that you can present your PROOF and your worries to APS and ask that they open a case on a wellness check. They will visit your parent and ask for the documents.

You say that currently the hospital has been given a false POA. Again, you must have PROOF of these accusations, and you can request the social workers to investigate. So call them today.

Who are you concerned about? A parent? Does your LO need someone to make decisions and manage their care? You may need to report them to APS or talk to social services about court assigned guardianship — assuming the LO is no longer has legal capacity to actually assign a PoA.

It would help if we were better informed. For Mom or Dad or both? What's the health conditions? In my case,it was in my mom's will which was certified at a local courthouse, you may find a copy there if they made one out. If your loved ones have a safe deposit box,it might be in there also. This is why more information comes in handy,age and if they haven't made out documents for care leaves you in limbo. Health conditions, are they mentally able to make out any plans or has dementia set in making it a court issue, getting guardianship? You should ask them if they made out a will and/or healthcare directive. This is where you start and hopefully you find some answers.
