One question, why isn't the FBI on this case if in fact $100k had been stolen?

She is like my second mom. There is so much more to the story than just her son stealing money. I think I will go to FBI, this happens a lot.

charladyfl, are you saying this person who is like a second Mom to you is telling you this? From your profile it says that she has Alzheimer's/Dementia. Is she in a nursing home because of her memory issues? There is a stage of these diseases where a person will make up stories. Curious why is the IRS involved?

I can't imagine what you think the FBI would do about this. She would make a poor witness if she even understands what happened. If she still had the money it would still be gone, just to a NH instead of a relative. There is really no agency that is going to pursue him criminally. What are you really expecting?

Over what period of time did this poor lady's son bleed her dry?

I helped her because I love her, she was my second mom and best friend. Twenty years, after she started showing sign of illness, I became her guardian angel. When people try to take advantage, I would intervene, if her home needed repairs, my husband and I would fix or find someone to do the work. Her son refused to help her. He had his own family to worry about. Then her son later took advantage after her illness got worse, and then everything went crazy. Her son was her beneficiary in her will, he just became impatient waiting for his money, as he put it. I told him it was not his money and may be needed for her long-term care. He convinced her that the doctor and I were wrong and he would take care of her. Then he left her without food and care, as he went on big spending spree. I have all the back up to prove and gave the info to Family Service twice. Finally Family Service, her doctor and myself her health surrogate had her sent to a home where now she is safe,

Is there some federal law you think has been broken and that FBI will that now go after the perp? Really? Aren't you just feeling frustrated? Assuming you got anywhere on this track, do you think she would want to know that her son is in prison? Or do you somehow think the money can be restored to her? This is really a fruitless pursuit to deal with your feelings. Don't waste the government's time with this. Let the FBI go on with things of broader scope, like terrorism investigations.

FBI also deals with *White Collar* crimes. But one has to have solid proof that a crime had been committed.

I am still curious why the IRS is involved.

This is not white collar crime, it's family problems. There's no reason for either the IRS or FBI. Come on guys, get real.

Char, if she's safe in a nh, why does anything else matter?

The appropriate agency to bring charges against him is he county in which the crime was committed. You should contact the District Attorney's office. The FBI wouldn't prosecute a case like this.

You are right nothing else matter, she is safe now in a nursing home, happy and safe.

disagree, this is clear financial exploitation and stealing from taxpayers who are now footing this woman's care; even if he can't pay the money back, it needs to serve as a lesson to others - Medicaid has been making such a big deal about this I don't understand why they're not involved in it

Taking care of an elderly person is by no means cheap or free, and it depends on how he spent the money--sitters are about $20 an hour; in addition, a caregiver pretty much has to quit their job to care for a mentally incompetent person. Repairs to the home, and vehicle, including homeowner's and car insurance, will bleed money dry very quickly too. My question is where were you during this alleged abuse, and why were you not involved with the person's care. If the person is in a nursing home, the facility would have confiscated the money--otherwise she would not be eligible to be in a nursing home. Actually they probably did this already since she's on Medicaid. A person on Medicaid is not allowed to have any more than $2,000 in the bank. If you were so worried about this alleged abuse, it makes me question why you didn't act upon this sooner instead of being more worried about the money.

I wonder if both names were on the account as you said her ssa check went to, wouldn't that mean he could spend the money freely? I was on an account with my aunt once and though I never touched her money, I could have.

--since she's in a nursing home and on Medicaid they do a five year look back law. Chances are Medicaid confiscated her savings--now the nursing home will simply kill her with abuse and neglect and the government did what they intended to do.

if she's in a nursing home and Medicaid they did a five year lookback law and the US Government confiscated her savings. Now the nursing home will kill her with abuse and neglect and the US Government accomplished their intent.

It call bloated gov’t. I call the doctor, police, DCF over and over. The last time DCF came to her house, they found her dirty, no food in refrig. DCF received year and half of bank statements and interview him and his wife for criminal acts, which they found true and did nothing again. I was told I was not a family member or her PA anymore (son had mine PA revoked), but he forgot to remove me as health surrogate, so DCF and her Doctor had to talk to me. So I request her to be remove and put somewhere safe. So my last attempt was to make sure she was in NH and was safe. I was told he would have to spent all her money before they would go after him and his wife. Her son was on vacation on a island with the last of her money. He also continue to use her social security 6 month and annuity for a year while she was in NH. Medicare also received the infor. for the seven year look back as well and yet again the system fail. Yes her money should go to NH not son’s play money, as he said it’s his right and his inheritance and I said no it should go to her long term care, any money left was then his inheritance.
