I am his Only deceased daughter's daughter. His only next of kin living. I requested to have him placed in a nursing rehabilitation home and his girlfriend discharged him without my knowledge and he is nowhere to be found. he needs 24 care

Is your grandmother still alive, if so, she is his next of kin even though they have been separated for many years without a divorce, they are still legally married.

Does your grandfather's girlfriend/significant other have medical Power of Attorney? If yes, than she can take your grandfather out of the rehab facility without your knowledge. Did the girlfriend take him out of the rehab against advice of the rehab staff or was he ready to go home? Is there a reason why she isn't communicating with you?

My grandmother passed in 2004. this lady is old and she knows that I am the decision maker. I thought that was established, but I guess not. I really have no idea what documents she has on my grandfather. HE cant tell me. I have been in touch with the hospital social worker and she informed me that my grandfather is better off getting treatment in a nursing home, 24 hour care is needed and that if he returns to his apartment he'll only be given 12 hour HHA, leaving him alone until the am

Auribria, sorry to hear about your grandmother's passing. Do you have the medical and financial Power of Attorney? Or was your grandmother your grandfather's POA?

Regarding the girlfriend, you feel she couldn't care for your grandfather because "this lady is old"? Why is that? My Mom is 97 and is taking wonderful care of my Dad, who has age related decline. I realize your grandfather must have certain health issues that wouldn't make it easy for him to stay in his apartment with his girlfriend.

Auribria, he is not alone if the girlfriend is there. You can file a missing person report if he cannot be found. Work with the Social Worker, she can find him and check his welfare.
