In 2011 my mother revoked my sister as POA! She has given full control to her lawyer! My mother an I have been trying to get my name added since Dec. Do we have to get a lawyer to get this done?

Why on earth would you want that responsibility? POA's have to account for every penny, they are fully responsible if the patient is injured. Do you know what the laws are in your state?

If mom is competent, she should be able to revoke the lawyer's POA or make any other change she needs to. If the lawyer who is current POA has failed to live up to the responsibilities of he or she could be removed as POA. If mom is not competent though, someone will have to look at a guardianship if the lawyer is not doing a satisfactory job.

How has your mother been trying to get your name added? If she is competent this is a very easy change. If she is not cognitively competent (in the legal sense) then that is a different matter altogether.

More than one POA is usually a problem. I would leave it with the lawyer.

I agree with Pam that adding your name as a second POA is not a good idea. Is the lawyer dragging his/her feet on this, trying to convince your mother that multiple POAs are not in her best interest? I can kind of understand that.

But ... your mother revoked a previous POA so she knows it can be done and how to go about doing it. If she wants to replace the lawyer with you in that role, then that should be easily accomplished, assuming she is competent.

Could you explain the situation in a little more detail? Maybe we are failing to grasp the big picture here.
