This guy needs home care . All involved agree. His fiduciary will not pay my wages. what to do?

VA wants to see a written care contract and weekly documentation of hours. Those hours must conform with the recommendations on the Form 21-2680 (Aid & Attendance application)

Take it to small claims court. I hope you have a contract and can prove you are actually owed money, the more documentation you have the better.

Sorry, Pam's response makes me wonder how this is set up, are you employed by the VA or are you hired directly by the person you are caring for?

The way reg. Office explained is the vet and or family can pick someone if they have avail person ....could even be a family member. If dont have there are agencies to use. I had to and pass a general interview type thing with a social worler and bos Dr. But basically ....he approached me. His Dr.s asked me to help him .....so i am .the fiduciary says shes not paying a cent until he gets an increase on his benefits. My understanding is he wont get an inctease until they see hes been paying it regularly.

So get a written contract from him, for the hours called for. Submit the time sheets to her, with his signature on them authorizing the pay and keep a copy for your records and the VA. Just follow the rules and you will get paid
