I have poa in a upaa state. I have poa financial and medical. she has been shut in and lost her licence and I believe she has had a stroke. She lives in Virginia and I live in Utah. I want to move her here into an assisted living community. I fear she will fight me. The only other member of family is her nephew who has helped her and her friends have asked for me to step up and take more control.

She made you PoA. That means that she trusted you at some point to make decisions for her. Of course, reasoning with a dementia patient is pretty useless.

If she " fights" you, you need to resign your POA in an orderly fashion so that she can become a ward of the state.

You might have others who are living nearby point out that then she would have no input into where she is cared for.

thatjames, sounds like you haven't asked your Grandmother[as per your profile] what she wants to do, that is if her mind is still sound.   She might surprise you and say yes.   But you need to check to see if she is on Medicaid [I assume she already has Medicare].   If she is on Medicaid, when she crosses the State line, that Medicaid goes away and she needs to apply and get approved within Utah.

Otherwise, if Grandmother refuses to move, you just have to wait for a crises to happen where the elder goes to the hospital, then into rehab or a nursing home.

At that point you can tell the hospital/rehab/nursing home that Grandmother has no one at home to take care of her.   Then look for a continuing care facility that will also take Medicaid later down the road.

At that point you can close up her home.   Sell the house.   The house might have a Medicaid lien placed on it so Medicaid can recoup what they have paid out for her care.  If no lien, then use that money as self-pay for the nursing home.

You retain an attorney in Virginia for a guardian hearing. He should be paid from her funds.
