Unfortunately an order of protection was denied for my mother. The magistrate stated that even though there appears to be "psychological" abuse, the definition for an order of protection requires "physical" abuse. On his suggestion, we went ahead and had our attorney complete a Durable Power of Attorney and have shown it to my sister. She's fighting us tooth and nail to get back into mom's home but at least we now have the DPOA to back us. It seems as though there's a disconnect with this type of situation as related to any legal remedy.
